Terms and Conditions
These Terms and Conditions ("Terms") govern the use of the webshop operated by PORCUPINE FILMS KFT and the sales contracts concluded through it. By placing an order you confirm that you have read, understood and accepted these Terms and our Privacy Policy.

Scope and legal background
These Terms apply to every order placed in our webshop. Matters not regulated here are governed by Hungarian law, in particular by Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce, Act CLV of 1997 on consumer protection, Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, and Government Decree 373/2021 (VI. 30.) on the detailed rules of contracts for the sale of goods and the supply of digital content.
"Consumer" means a natural person acting outside the scope of their profession, self-employed activity or business. Provisions of these Terms that grant specific consumer rights apply only to consumers.
Products and prices
- Prices are shown in Hungarian forint (HUF) and include VAT. They do not include the shipping cost, which is calculated and displayed separately at checkout before you place your order.
- Product photos are illustrative; minor differences in colour or texture caused by your screen settings or by the nature of the material do not constitute a defect.
- We reserve the right to change our prices at any time. A price change takes effect when it is published on the site and does not affect orders already confirmed.
- If, despite our best efforts, a product is displayed at an obviously incorrect price – for example a price of HUF 0 or a price that clearly results from a technical error – we are not obliged to sell the product at that price. In such a case we inform you and offer to fulfil the order at the correct price, which you are free to refuse.
- Products are offered while stocks last. If an ordered product is unavailable, we inform you and refund any amount already paid without undue delay.
Placing an order
You can order without registration or through a customer account. The order process is as follows:
- Select the product and add it to the cart, choosing quantity and any available options.
- Open the cart and check its contents. You can change quantities or remove items at any time before placing the order.
- Enter your billing and delivery details, then choose a delivery method and a payment method.
- Review the summary page, which shows the products, the total price, the shipping cost and all data you entered. Data entry errors can be corrected on this page by going back and modifying the relevant field.
- Place the order by clicking the button marked with a payment obligation. Clicking this button creates an obligation to pay.
After placing your order we send an automatic acknowledgement by e-mail confirming that we received it. If this acknowledgement does not reach you within 48 hours, you are released from your offer and from any obligation to accept the products.
The sales contract is concluded when we send you a separate order confirmation e-mail stating that we accept your order and, where applicable, that it has been dispatched. The contract is concluded in electronic form, it does not qualify as a written contract, it is not filed by us in a way that would later make it individually accessible, and it is concluded in English. Its content is documented by the order data and the confirmation e-mails, which we recommend that you keep.
Payment
- The payment methods available to you are displayed at checkout. Your order is processed once the payment has been completed successfully.
- Card payments are handled by our payment service provider through its own secure interface. We never receive, see or store your full card number, expiry date or security code.
- We issue an electronic invoice for every order and send it to the e-mail address you provided. By placing an order you accept the use of electronic invoices.
- If a payment fails or is not completed, the order is not processed and no contract is concluded.
Shipping and delivery
Detailed delivery methods, delivery areas, prices and delivery times are set out on our Shipping Information page, which forms part of these Terms. In summary:
- Domestic orders are delivered by Foxpost, Packeta and GLS to parcel lockers, pick-up points or home addresses; personal collection in Budapest is available by prior arrangement.
- International delivery within the European Union is available through Packeta to the countries listed on the Shipping Information page.
- Orders are processed and dispatched within 2–4 days. Domestic delivery normally takes a further 1–3 working days; international delivery times vary by country.
- Domestic delivery to a parcel locker is free for orders above HUF 24,000.
Please check the parcel in the presence of the courier or immediately after collection. If you notice visible damage to the packaging or the product, ask for a damage report to be recorded and notify us as soon as possible; this makes it considerably easier to handle your claim, but does not affect your statutory rights.
The risk of loss or damage passes to you when you or a third party indicated by you, other than the carrier, takes physical possession of the products.
Right of withdrawal
If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason, in accordance with Government Decree 45/2014 (II. 26.).
- The withdrawal period expires 14 days after the day on which you or a third party indicated by you, other than the carrier, acquires physical possession of the products. In the case of multiple products ordered together but delivered separately, the period runs from the receipt of the last product.
- To exercise the right of withdrawal, send a clear statement of your decision to faisztl@porcupinefilms.hu before the deadline expires. You may use the model form below, but it is not mandatory. It is sufficient to send your statement before the deadline.
- You must return the products to our address without undue delay and in any event no later than 14 days from the day on which you communicated your withdrawal. The deadline is met if you send the products before the 14-day period expires.
- You bear the direct cost of returning the products. We cannot accept parcels returned as cash on delivery.
- We refund all payments received from you, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed of your withdrawal. We use the same means of payment as you used for the original transaction, unless you expressly agree otherwise; no fee is charged for the refund. If you chose a delivery method more expensive than the least expensive standard method offered by us, we refund only the cost of the standard method.
- We may withhold the refund until we have received the products back or until you have supplied evidence of having sent them back, whichever is the earlier.
- You are liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
The right of withdrawal does not apply, among the cases listed in Section 29 of Government Decree 45/2014 (II. 26.), to:
- products made to your specifications or clearly personalised;
- sealed audio or video recordings and sealed computer software, if the seal was broken after delivery;
- sealed products which cannot be returned for health protection or hygiene reasons, if the seal was broken after delivery;
- products which, after delivery, are inseparably mixed with other items due to their nature;
- digital content supplied on a non-tangible medium, where performance has begun with your prior express consent and your acknowledgement that you thereby lose your right of withdrawal.

Warranty for defects, product warranty and guarantee
Warranty for defects
In the event of defective performance you may assert a warranty claim against us under the Civil Code. You may request repair or replacement, unless this is impossible or would result in disproportionate additional costs for us; failing that, you may request a proportionate reduction of the price, have the defect repaired at our expense, or withdraw from the contract. You may switch between the chosen warranty rights, but you bear the cost of switching unless it was justified or caused by us.
You must notify us of the defect without delay after discovering it, and in any event no later than two months after discovery. Consumers may enforce warranty claims within two years of performance; non-consumer buyers within one year. In the case of a consumer contract, any defect that becomes apparent within one year of delivery is presumed to have existed at the time of delivery, unless this presumption is incompatible with the nature of the product or of the defect.
Product warranty
If a product is defective, a consumer may also choose to assert a product warranty claim directly against the manufacturer or distributor of the product, requesting repair or replacement. A product is defective if it does not meet the quality requirements in force when it was placed on the market, or if it does not have the characteristics described by the manufacturer. Product warranty claims may be enforced within two years of the product being placed on the market by the manufacturer. The manufacturer is exempt only on the grounds set out in the Civil Code. You may not assert a warranty for defects and a product warranty claim for the same defect at the same time.
Guarantee
A mandatory guarantee (jótállás) applies only to products that fall within the scope of Government Decree 151/2003 (IX. 22.) on the mandatory guarantee for certain consumer durables. Where a product we sell falls within that scope, or where we or the manufacturer voluntarily provide a guarantee, the guarantee conditions are communicated with the product. A guarantee does not affect your statutory warranty rights.
Complaints and dispute resolution
Please send any complaint to faisztl@porcupinefilms.hu. We investigate written complaints and reply in substance within 30 days, stating our reasons if we reject the complaint. We keep the record of the complaint and a copy of our reply for five years, in accordance with Section 17/A of Act CLV of 1997 on consumer protection.
If your complaint is rejected, you may turn to the following bodies:
- Consumer protection authority: the district office (járási hivatal) competent for your place of residence. A list is available at kormanyhivatalok.hu.
- Conciliation board: an out-of-court forum for the amicable settlement of consumer disputes. The board competent for our seat is the Budapesti Békéltető Testület, 1016 Budapest, Krisztina krt. 99., postal address 1253 Budapest, Pf. 10., e-mail bekelteto.testulet@bkik.hu, website bekeltet.bkik.hu. You may also turn to the board competent for your own place of residence. We are obliged to cooperate in conciliation board proceedings.
- Consumers resident in another EU Member State may seek assistance in cross-border disputes from the European Consumer Centre network, in Hungary the Európai Fogyasztói Központ (magyarefk.hu).
- Court proceedings: you may also enforce your claim before the competent Hungarian court.
Liability
We use the products only as intended and in accordance with any instructions supplied. We are not liable for damage resulting from improper use, unauthorised modification, normal wear and tear, or storage in unsuitable conditions.
We make reasonable efforts to keep the website available and free of errors, but we do not guarantee uninterrupted, error-free operation, and we are not liable for damage arising from technical faults, maintenance, internet outages or events beyond our reasonable control. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Hungarian law, in particular liability for damage caused intentionally, or for damage to human life, physical integrity or health.
Data protection
We process personal data in accordance with our Privacy Policy, which sets out what data we collect, for what purposes and on what legal basis, who we share it with, how long we keep it and what rights you have under the GDPR.
Amendments and severability
We may amend these Terms at any time. The amended version applies from its publication on the website and does not affect contracts already concluded. Orders are always governed by the version of the Terms in force at the time the order was placed.
If any provision of these Terms becomes invalid or unenforceable, the remaining provisions remain in full force and effect.
These Terms are governed by Hungarian law. If you are a consumer, this choice of law does not deprive you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.

This Privacy Policy describes how PORCUPINE FILMS Gyártó és Szolgáltató Korlátolt Felelősségű Társaság collects, uses, shares and protects your personal data when you visit our website, create an account, place an order, subscribe to our newsletter or contact us.
We process personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (General Data Protection Regulation, "GDPR") and Act CXII of 2011 on Informational Self-Determination and Freedom of Information (the "Info Act").

Personal data we process
1. Orders and performance of the contract
- Data processed: name, e-mail address, phone number, billing address, shipping address or chosen parcel point, order number, ordered products, order value, payment method, order history.
- Purpose: to conclude and perform the sales contract, to process, package and ship your order, and to keep in touch with you about it.
- Legal basis: performance of a contract – Article 6(1)(b) GDPR; for the mandatory data of electronic contracting also Article 13/A of Act CVIII of 2001 on electronic commerce.
- Retention: 5 years from performance of the contract, in line with the general limitation period under Act V of 2013 on the Civil Code.
2. Invoicing and accounting
- Data processed: name, billing address, tax number (if provided), items, amount, date of issue, payment data.
- Purpose: issuing invoices and retaining accounting records.
- Legal basis: compliance with a legal obligation – Article 6(1)(c) GDPR; Act CXXVII of 2007 on Value Added Tax and Act C of 2000 on Accounting.
- Retention: 8 years, as required by Section 169(2) of Act C of 2000 on Accounting.
3. Shipping and delivery
- Data processed: name, shipping address or selected parcel locker or pick-up point, e-mail address, phone number, parcel number.
- Purpose: delivery of your parcel, parcel tracking, delivery notifications and handling of failed deliveries.
- Legal basis: performance of a contract – Article 6(1)(b) GDPR.
- Recipients: FOXPOST Zrt., Packeta Hungary Kft., GLS General Logistics Systems Hungary Kft. These carriers process your data under their own privacy notices.
- Retention: 5 years from delivery, together with the related order data.
4. Payment
- Data processed: name, e-mail address, amount, currency, transaction identifier, payment status.
- Purpose: processing your payment and preventing fraudulent transactions.
- Legal basis: performance of a contract – Article 6(1)(b) GDPR; fraud prevention is based on our legitimate interest – Article 6(1)(f) GDPR.
- Important: card payments are processed by our payment service provider. We never receive, see or store your full card number, expiry date or security code.
- Retention: 8 years for the payment records forming part of our accounting documentation.
5. Customer account (registration)
- Data processed: name, e-mail address, password in encrypted (hashed) form, saved addresses, order history.
- Purpose: creating and operating your user account, faster checkout, access to your previous orders.
- Legal basis: performance of a contract – Article 6(1)(b) GDPR.
- Retention: until you delete your account, or after 3 years of inactivity. Deleting your account does not affect data we must keep for accounting or legal purposes.
6. Newsletter and marketing messages
- Data processed: name, e-mail address, date and technical data of your consent, delivery and opening statistics of our messages.
- Purpose: sending newsletters, product news, promotions and personalised offers.
- Legal basis: your consent – Article 6(1)(a) GDPR and Section 6 of Act XLVIII of 2008 on the basic requirements of commercial advertising activity.
- Retention: until you withdraw your consent. You may unsubscribe at any time using the link at the bottom of every message or by writing to us; withdrawal does not affect the lawfulness of processing carried out before it.
7. Complaints, returns, withdrawal and warranty claims
- Data processed: name, contact details, order data, content of the complaint or claim, bank account number in case of a refund, correspondence.
- Purpose: handling consumer complaints, withdrawal from distance contracts, returns and warranty claims.
- Legal basis: compliance with a legal obligation – Article 6(1)(c) GDPR; Act CLV of 1997 on Consumer Protection and Government Decree 45/2014 (II. 26.).
- Retention: 5 years from the recording of the complaint, in accordance with Section 17/A of Act CLV of 1997; 8 years for refund records forming part of our accounting documentation.
8. Contacting us
- Data processed: name, e-mail address and any other information you choose to include in your message.
- Purpose: answering your question and keeping a record of the correspondence.
- Legal basis: our legitimate interest in responding to enquiries – Article 6(1)(f) GDPR; or, where the message concerns an existing order, performance of a contract – Article 6(1)(b) GDPR.
- Retention: 1 year from closing the enquiry, unless it becomes part of a complaint or legal claim.
9. Website operation, server logs and IT security
- Data processed: IP address, date and time of visit, pages visited, referring URL, browser and operating system type, device identifiers.
- Purpose: operating the website securely, detecting and preventing abuse, attacks and errors.
- Legal basis: our legitimate interest in the secure operation of our services – Article 6(1)(f) GDPR.
- Retention: server logs are kept for a maximum of 12 months.
Cookies
Our website uses cookies and similar technologies. Strictly necessary cookies are placed on the basis of our legitimate interest under Article 6(1)(f) GDPR; functional, analytics and marketing cookies are placed only with your prior consent under Article 6(1)(a) GDPR. Details of the individual categories and of how to manage your settings are set out in our Cookie Policy.
Who we share your data with
We do not sell your personal data. We disclose it only to the following categories of recipients, and only to the extent necessary:
- our hosting and webshop platform provider, who stores the data of the website;
- our delivery partners: FOXPOST Zrt., Packeta Hungary Kft., GLS General Logistics Systems Hungary Kft.;
- our payment service provider, who processes the payment transaction;
- our invoicing software provider and our accountant;
- our e-mail and newsletter service provider;
- our analytics and advertising service providers, subject to your cookie consent;
- authorities, courts and our legal advisors, where disclosure is required by law or necessary to establish, exercise or defend legal claims.
Where these partners act as processors, they process personal data solely on our documented instructions, under a data processing agreement concluded in accordance with Article 28 of the GDPR. You may request the current list of our processors at faisztl@porcupinefilms.hu.
International data transfers
We primarily store and process personal data within the European Economic Area (EEA). If any of our service providers processes data outside the EEA, we ensure an appropriate level of protection under Chapter V of the GDPR – typically on the basis of an adequacy decision of the European Commission or the Standard Contractual Clauses adopted by the Commission under Article 46(2)(c) GDPR, supplemented where necessary by additional safeguards. You may request a copy of the relevant safeguards from us at the contact details above.
Data security
We implement appropriate technical and organisational measures under Article 32 of the GDPR to protect your personal data against unauthorised access, alteration, disclosure, loss or destruction. These measures include encrypted (HTTPS/TLS) data transmission, password protection and hashed password storage, restricted and role-based access rights, regular backups, up-to-date software and confidentiality obligations for everyone acting under our authority. No system can be guaranteed to be completely secure; in the event of a personal data breach we act in accordance with Articles 33 and 34 of the GDPR.
Automated decision-making and profiling
We do not carry out automated decision-making producing legal effects concerning you or similarly significantly affecting you within the meaning of Article 22 of the GDPR. If you consent to marketing cookies, limited profiling may take place for the purpose of displaying relevant advertisements; you may object to this at any time.
Children
Our website and webshop are not directed at children. We do not knowingly collect personal data from persons under the age of 16 without the consent of the holder of parental responsibility. If you believe that a child has provided us with personal data, please contact us and we will delete it without undue delay.
Your rights
Under Articles 15–22 of the GDPR you have the following rights in relation to your personal data:
- Right of access: to obtain confirmation of whether we process your data and to receive a copy of it.
- Right to rectification: to have inaccurate data corrected and incomplete data completed.
- Right to erasure ("right to be forgotten"): to have your data deleted where one of the grounds in Article 17 applies and no legal obligation requires us to keep it.
- Right to restriction of processing: to have processing limited in the cases listed in Article 18.
- Right to data portability: to receive the data you provided to us in a structured, commonly used, machine-readable format and to have it transmitted to another controller, where processing is based on consent or contract and carried out by automated means.
- Right to object: to object at any time, on grounds relating to your particular situation, to processing based on our legitimate interest; and to object at any time, without giving reasons, to processing for direct marketing purposes.
- Right to withdraw consent: where processing is based on consent, you may withdraw it at any time without affecting the lawfulness of processing before the withdrawal.
To exercise your rights, please write to us at faisztl@porcupinefilms.hu or to our registered seat. We respond to your request without undue delay, and in any event within one month of receipt. This period may be extended by a further two months where necessary, taking into account the complexity and number of requests; we will inform you of any such extension and of its reasons. We may ask you for additional information to confirm your identity.
Remedies
If you consider that our processing of your personal data infringes the law, please contact us first – most issues can be resolved quickly and directly.

You may also bring a claim before the courts. The lawsuit may be filed, at your choice, with the tribunal competent for your place of residence or stay, or with the Budapest-Capital Regional Court (Fővárosi Törvényszék). If you are a resident of another EEA Member State, you may also lodge a complaint with the supervisory authority of that Member State.
Changes to this Privacy Policy
We may amend this Privacy Policy from time to time, for example if our services, our service providers or the applicable legislation change. The current version is always available on our website with the effective date indicated below. In the case of material changes, we will notify you by e-mail or by a notice on the website before the changes take effect.

This Cookie Policy explains what cookies are, which types we use on the website of PORCUPINE FILMS KFT, why we use them and how you can control them. It supplements our Privacy Policy, which describes how we handle personal data in general.
What cookies are
Cookies are small text files that a website places on your device when you visit it. They allow the site to recognise your browser on your next visit, to remember your settings and to measure how the site is used. Similar technologies – such as pixels, local storage and software development kits – work in comparable ways, and everything written here about cookies applies to them as well.
Cookies are either first-party cookies, placed by us, or third-party cookies, placed by our service providers. They are also either session cookies, which are deleted when you close your browser, or persistent cookies, which remain on your device until they expire or until you delete them.

Consent
When you first visit our website, a cookie banner asks for your choice. Strictly necessary cookies are placed immediately, because the site cannot function without them. Functional, analytics and marketing cookies are placed only after you accept them.
Your choice is stored in a cookie so that we do not have to ask again on every page. You can change or withdraw your consent at any time in the cookie settings available on the website; withdrawal does not affect the lawfulness of any processing carried out before it. If you clear your browser data, your stored preference is deleted and the banner appears again.
Third-party cookies
Some cookies are set by our service providers, for example by our analytics and advertising partners, by embedded video players and by social media plugins. These providers may process the data collected through their cookies as independent controllers, under their own privacy notices, and may combine it with data from other websites you visit. Embedded content is only loaded after you have given the corresponding consent.
